Terms of Use

These terms apply to the MindIsland app and to mindisland.net, provided by Ham Technologies, LLC ("we"). By using MindIsland, you agree to them.

1. Not therapy, medical care or a crisis service

MindIsland is a self-care and reflection app. It does not provide therapy, counseling, diagnosis, treatment or medical advice, and it is not an emergency or crisis service. Nothing in the app, including the companion's replies and the guided sessions, replaces a qualified professional.

If you might hurt yourself or someone else, contact your local emergency number now. In the U.S., call or text 988.

2. Adults only

You must be 18 or older to use MindIsland.

3. The AI companion

The companion's replies are generated by an AI service, Google Gemini, and may be inaccurate, incomplete or inappropriate for your situation. Do not rely on them for medical, mental-health, legal, financial or other professional decisions. The app sends your messages to the AI only after you allow it, as described in the Privacy Policy.

4. Your content

You keep any rights you have in what you write. You give us only the permission needed to pass your companion messages to the AI service to produce replies, as the Privacy Policy describes.

5. Acceptable use

Use MindIsland lawfully and for your own personal self-care. Do not try to disrupt or overload our server, get around its limits, reverse-engineer it, or use the companion to produce content that is harmful or illegal.

6. Intellectual property

The app, its sessions, artwork and sounds belong to us or our licensors; sound credits are listed in the app. You may use MindIsland for personal, non-commercial purposes.

7. Availability and changes

MindIsland is free. We may change, suspend or discontinue any part of it, including the companion, at any time.

8. Disclaimer of warranties

MindIsland is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, Ham Technologies, LLC is not liable for any indirect, incidental, special or consequential damages, or for any loss arising from your use of MindIsland or your reliance on its content.

10. App stores

If you downloaded MindIsland from the Apple App Store, Apple's standard licensed application end user license agreement also applies, and Apple has no obligation to provide support or maintenance for the app.

11. Changes to these terms

We may update these terms; the date at the top shows the current version. If you keep using MindIsland after a change, you accept the updated terms.
